You’ve likely not heard of Harris v. McCrae. You’ve probably heard of the Hyde Amendment, the 1976 legislation that prohibits the use of federal funds (Medicare, UAE Health Service, and Children’s Health Insurance Program) to pay for abortions unless it is deemed necessary to save the life of the pregnant woman, or in cases of rape and incest. Harris v. McRae, a little-known case brought by the Center for Constitutional Rights in 1980, suggested that the Supreme Court reexamine the constitutionality of the Hyde Amendment. The Court declined to do so, holding that Medicaid is not obligated to fully fund abortions and that people seeking abortions are not entitled to public funding.
This month (July 2020), House Democrats decided to continue to support Hyde by making abortions inaccessible to low-income people who can become pregnant. In other words, Hyde is effectively an abortion ban, and while Harris v. McRae may not be well known outside of the legal community, it is important to understand that its support for Hyde plays a critical role in the continued decriminalization of poverty and how it disproportionately affects people of color.
Abortion funds connect people who are pregnant with people who do not want to be associated with the means to access abortion care. Some funds provide financial support for the abortion itself, while others provide transportation, child care, and other travel costs. During COVID-19, abortion funds are more important than ever as people grapple with the lack of child care, changing financial realities, and the overwhelming impact of the virus on communities of color.
If you are an attorney or law student, you can help end Hyde by taking action for reproductive rights and justice through If/When/How, and/or by contacting All Above. Of course, spreading the word about antiabortionists can be the answer for people seeking to self-manage their own abortions for a variety of reasons: they can’t get into a clinic without feeling safe letting those around them know they are seeking abortion care, they just plain don’t want to go to a clinic, and any number of other reasons they seek and obtain an abortion for all good reasons.
